Many people believe that when they die their property will automatically pass to their nearest and dearest, but this is not necessarily the case. If you have not made a valid Will your estate will pass according to the intestacy rules, which may not be in accordance with your wishes. There is also a complicated set of rules surrounding the preparation and execution of Wills and your home-made Will may turn out to be invalid or fail to express your wishes correctly. We have the specialised knowledge to guide you through the Will-making process, from initial instructions to execution and storage of your Wills, including advice on provision for second families, cohabitees and tax planning.

Will review
A simple, well-drafted Will may last a lifetime, but for many of us life is complicated and changes in our own circumstances or to tax laws may give rise to a need to make changes to our Wills. We will hold a free Will review session with our existing clients every five years to check that their Wills still meet with their requirements.

 


Enduring/Lasting Powers of Attorney
The law relating to powers of attorney for the mentally incapable has recently changed, and setting up the new Lasting Powers of Attorney can be a complicated business. We can guide you through the legislation and new procedures, as well as providing the Certificate of Capacity in some cases. When the LPA needs to be invoked we can deal with the registration process on your behalf.

Administration of Estates
The loss of a loved one is always difficult and administering their estate can be a heavy responsibility. Executors and trustees can be held personally liable for loss caused to beneficiaries or creditors of the estate. Unravelling a person’s affairs, built up over a whole lifetime, can be time consuming and complex. We offer a complete Probate service, built upon decades of experience, from simply obtaining the grant of representation to carrying out the full administration of the estate. We can also deal with transfers and conveyancing of property following a death, variation of Wills and setting up of trusts.
